Hi I'm looking for some advice. I have been getting lwp for years. In January if 2022 I changed my health condition as it had worsened and I got adviced off my work coach I should be in the LWRCA and I would need a reassessment anyway nothing came of it I just kept going to my monthly meetings until October of 2022 I started putting fit notes in as I was finding it too difficult to go in. Was changed to telephone calls. A different work coach rang me on 15th February 2023 and said straight away I should be on LWRCA and wasn't sure why my normal work coach hadn't sent me a uc50 form for a reassessment the year before so he did that straight away I received it and sent it back. I got a reassessment in may this year. Got awarded LWRCA and while waiting may I add I still always continued sending fit notes so no gaps. Anyway my question to this is should I be awarded any back payment? They're saying absolutely not but I thought I would have past the 3 month waiting period and awarded some sort of back payment but they're saying absolutely not? Sorry for the long post I have just got no where with them and looking for some answers/advice. Thankyou for reading.

I can't answer your question but I am sure someone will be along soon that can.
I wanted to ask when you sent the UC50 back did you have to go for an assessment (either over the phone, face to face etc) or did they award you LWRCA just based on what you wrote on the form?0 -
Back in January 2022 your work coach should have advised you to report a change of circumstances and click health condition, on there you should have reported a worsening of condition. This would have then prompted you to provide a fit note.If you have proof of your work coach telling you that a new assessment would be needed back in Jan 2022 then you can argue that you were poorly advised at that time and didn't know you needed a new fit note.As you previously had LCW then the waiting period doesn't apply because you reported changes. This means you'll be entitled to the extra money from the assessment period in which you reported the changes. Which would be Jan 2022 if you have proof of what your WC told you.Otherwise it will be Oct 2022 when you started sending fit notes.0

Most people have assessments which are mostly by telephone. Some are face to face or video call.

Could someone please help me to a mandatory decision please0

Put a message on your journal under the payment section first and ask about the money that’s owed. It’s not unusual for money owed to take quite a few weeks for them to pay it. They have to recalculate your past statements first to work out how much you’ve been paid against how much you should have been paid. You will then receive the difference between the two. Once this is done you’ll receive a letter on your journal telling you how much is owed.0

They have to recalculate your past statements first to to what you've already been paid against what you should have been paid and you will then receive the difference between the two. Once this is done you'll receive a letter on your journal telling you how much is owed and it will then be paid into your bank. It may take a few weeks for them to do this.
