    Hello

    I was approved for LCWRA 1 September

    However, they asked all bank docs from 2020 decided I am not entitled to UC from 2021 they said too much in capital; they did not tell me if I had to pay anything back or not since July 2023 when all documents asked for.  I told them I did not know how things worked etc and not been advised, they told me in a PDF not entitled but the PDF did not say if overpayment etc from when UC opened in 2021.

    I got the ESA Arrears in June 2023.

    a) Since LCWRA applied 1 September I had zero UC payments from July 2023 now from June 2023 noticed as of 5 September there has been a zero payment even though I got something then before they asked for documentation
    i) Will I have to pay back what had from UC from August 2021 when I opened UC?
    ii) Will this just be zero payments from June 2023 per the judgement?
    iii) Will the UC still close after June 2023 after no six months activity even with LCWRA?

    If you’ve been told you’re not entitled to UC from 2021 then it’s likely you will have an overpayment and this will need to be repaid back.

    When you first claimed UC in the application form it will have asked you about savings/capital. Savings/capital of more than £16,000 means there’s no entitlement to any means tested benefits.

    If there’s no entitlement going forward because of capital then your claim will just close. It won’t remain open if you’re excluded because of savings/capital.

    Hello ok thank you, so if I have to reopen later will I have to do this all again i.e. send fit notes?  I do not know how long my ESA is for and understand reviews suspended.  I assume as that payment in June reverted to zero it may just close in Octobr, do you think they would have sent the overpayment letter today or back in July when they asked for the documents after the payment was set at zero on 5 September?

    If there’s no entitlement because of savings/capital then once they go below £16,000 then you can reclaim. As you’re in the Support Group for ESA then you will not need to go through another WCA for UC. Support Group is an ongoing award until a new decision says otherwise.

    Sorry I can’t tell you when you’ll receive the letter regarding how much you owe UC.
