Hi I hope someone on here can help me
I’ve been working for my employer for 7 years now but need an operation on my back and I will not be able to work for 12 weeks and he says he don’t pay sick pay because it comes out of his own pocket, I’ve been earning £166 per week all on the books
please someone help me this can’t be right ???

He is obliged by law to pay you Statutory Sick Pay.

provided you were earning at least £123/week in recent weeks.

If he thinks he do not qualify he must give you form SSP1 saying why not.
If may be able to claim Universal Credit at the same time as getting SSP but that which depend on your overall financial situation (assessed with a partner if you have one).
if you are not eligible for SSP you can claim new style ESA but this will be deducted from any UC you claim.Information I post is for England unless otherwise stated. Rules may be different in other parts of UK. -
I have asked for a ssp1 form explaining why he won’t pay , he’s reply why should I pay for something I don’t have
