The report is their opinion based on everything you sent and what you said during the assessment. The report is a recommendation only, while they usually go with it, it has been known for them to go against it.

Once the decision is made if you're not happy you can request the MR.

I'm so sorry @rachel3471 I wanted to comment and say, we are here if you ever need to talk or vent.

I also wanted to share the Citizen's Advice page on Mandatory Reconsideration. I hoped it would be a helpful read :)

Rachel - members on this forum have differing opinions on whether dwp assessors ‘lie’ (my personal opinion is you’re not the only one who has legit reasons to feel that way)

it’s a hassle but if the dwp report some untruths on you you have the believe the tribunal will catch them out but you need to provide them with as much info as possible

theres some great threads on this Subforum on how to best go through both mr and tribunal stages - best thing you can do now is to be proactive

It's not about "catching them out" HMCTS already know that some reports are flawed and they don't need to be reminded of this. Concentrating wholly on the report isn't helpful and isn't going to get anyone an award.

HMCTS will apply the law correctly but you need to state where and why you think you should have scored those points. Include detailed anecdotal evidence for each descriptor you think applies.

Oh no @rachel3471- such long waiting times  :( Would anything, in particular, help whilst you wait for a decision about your claim?

When you do request the MR you should put this in writing stating where and why you think you should have scored those points.

If you didn't include a couple of real world examples of the last time you attempted each descriptor that applies to you when you filled out the form then you should also do that. Adding detailed information such as where you were, what exactly happened, did anyone see it and what the consequences were.

As you're outside the 1 month timescale to request the MR then you'll need to give a reason why you didn't do this within the 1 month. Don't worry because you actually have 13 months in total. Just tell them that you didn't receive the decision letter that was sent out in May. If they refuse you can proceed to Tribunal.

@rachel3471 I'm so sorry that you wasn't awarded. I am keeping everything crossed for you with the Mandatory Reconsideration process.
