Hi, My daughter has had CP since birth and Ive applied for DLA on numerous occasions now and i've been rejected 3 times, i've had no support no one to turn to, no one to get advice from, even when my daughter got diagnosed we wasn't told about her diagnosis it was only until Her physiotherapist advised us she has a form of CP in passing conversation this was when she was 8 months old, she is now nine and is struggling with everyday tasks, she has had botox to help her mobility with her arm movement and she is in the process of getting an aid for her leg and foot movements. i'm going to apply for DLA again but this time i'm going to take it all the way, i feel i've been let down by all accounts, and i feel my daughter has slipped through the net which should never of happened. Any pointers in terms of the form or my next steps if i get rejected again,
Just a side note i included her diagnosis letter from her consultant which does'nt exactly say Cerebral palsy but it does mention her Hemiplegia,

To constantly reapply using the same evidence you previously used will highly likely see more refusals. When was the decision made on your most recent claim? If it was in the last 13 months then i'd advise you to challenge that decision by first requesting the Mandatory Reconsideration. (MR)If you're outside the 1 month timeframe then you need to give a reason why you didn't request it within the time. If they refuse you proceed to Tribunal. You need to prove that she has more care and attention needs of a child the same age that doesn't have a health condition.1

Thank you Poppy, so in terms of the evidence my first application was quite difficult as she was only 8/9 months old so trying to demonstrate why she had more care needs was difficult however i was told to apply by a medical profession, i then got rejected however i was fine with this as i didnt think there was much of an issue per say, i then applied when she was around 3 where her disability was more prominent i then got rejected again but i appealed, their grounds were she can walk and talk so i wasn't able to claim. i have used more evidence 3rd time round but again rejected,
This time i am getting more evidence from medical professions and also the school to advise them she has additional needs now more than ever as she is now behind in school she has also just been given a splint to help her walk a little better so hopefully she will be entitled to something. for me this isn't about the money this is about her been recognised as disabled for future.0 -
