My daughter was awarded middle rate dla
I get pip and am waiting on a lcwra decision.

Yes you will. However, the same person can’t receive both carers element and LCWRA at the same time. In this case the higher element would be paid, which would be LCWRA.1

I wouldn't be getting the childcare element as my daughter is in school and 15 years old so technically I wouldn't care for her for more than 35hrs a week if I'm correct?
So don't think I would qualify for that, just the child disability element
So if I do get lcwra would i still get the child disability element or not?
Sorry its all so confusing 😕 x0 -
Sorry if I am correct what your saying is the dla disability child element on u.c is still a carers element?0

If you’re found to have LCWRA then the disabled child element will not be affected as I advised.
No the disabled child element is not the carers element and neither is it the childcare element.Carers element is when you care for someone claiming a qualifying disability benefit. It’s the same sort of thing as carers allowance. Even though they are still in school, there’s still more than 35 hours/week when they are at home.1 -
OK so what your saying is if I get carers allowance or the carers element then I wouldn't be eligible for either one of them and lcwra at the same time
But the disabled child element I can claim with lcwra without neither being affected
The benefits system is so confusing 😩0 -
Disabled child element isn’t affected by any other element. It’s only the carers element that can’t be claimed by the same person that has LCWRA.If you’re claiming UC with a partner they can claim carers element.
Carers allowance is a separate benefit and isn’t affected by LCWRA. However, there’s no financial gain to claiming carers allowance at the same time as UC because it’s just deducted in full from any UC entitlement.1
