LCWRA appeal

Hi, I have a court hearing about LCWRA decision. I just sat down to go through everything, but I have one question. My first fit note was on 6th of March, I had surgery on 23rd of September, which made me feel better, and my LCWRA appointment was on 24th of October, when I was recovering after surgery feeling better. Assesor asked me questions mainly about how I felt THEN,and everytime I said I feel better, but my state before surgery was completely different. My question is- can I still get changed decision just for these months before surgery? I read somewhere that you can get an award just for few months, but cannot find it. Or, it just counts how are you feeling at the time of interview? I feel like it is unfair, not my fault they cancelled two of my assesements appointments. If anyone had similar experience, or knows about it, please let me know, as now I am thinking if there is even point of my appeal:-)Thank you.

They look at how your conditions affected you at the time the assessment took place. Remember though that it’s not just about one day, it’s about how you’re affected the majority of the time, so at least 50% of the time over a 12 month period.

Assessors and DWP always push people to say they are better so they wouldn't award them. Better to say you don't know if you are not sure .
