UC Managed mitigation failure

I was on Income Support with Severe disability premium, Enhanced disability Premium, child tax credit and housing benefit, I received a managed mitigation letter to move over so I did and it's been hell.

I was given £950 for my first payment, this is under £1300 of what I was recieving on legacy benefits and won't cover my rent and bills let alone feeding my 3 children and myself. I have rang 4 times UC and wrote in my journal under payment. Each time on the phone they say the case manager will contact me by 6pm the next day and each day I hear nothing. I am not affected by the benefit cap as I am on enhanced pip

I am lost at what to do anymore and where to turn. I have not been given any money for rent, not given severe or enhanced disability premium protection or UC managed mitigation transition protection and no-one is responding or helping fix this. Has anyone got any experience in this or have any ideas on what I can do or where to turn for help. This has affected my mental health massively and I've stumbled across this website on Google.     I've heard of this happening many times over the past few months or so and it's because some of your circumstances haven't been confirmed. UC very often do not calculate Transitional Protection either until after your first payment has been made so they have to make another payment once this has been done.

    When did you receive your first payment and what exactly did it include? Put a message onto your journal under the service issues rather than under payment section.

    I've read on rightsnet.org.uk that this is happening to people with children, that their children are getting missed off their claim, it might be worth checking if that's the isssue.

    I would also get my MP involved, you can send them an email if you search 'contact my MP' also have you got a local CAB? They are being funded by government to help with UC claims.

    They have given me the standard allowance and support for 2 of 3 children. My first pay was 29th June and I saw what I was getting on the 25th so wrote in my journal and rang them and called them 4 times since. The case manager has not contacted me from a request made on 7th May either so it's like they don't exist. They have not allocated me any rent allowance or the protection elements

    As it's only 4th June today I'm assuming the date of your payment is a typo and it was 29th May for your first payment, not June.

    For the child element, if one of them was born after April 2017 then you will only receive money for 2 children. Seems like they haven't yet confirmed your liability to pay rent, do you live in social housing or privately rented? Very often the rent isn't confirmed until after your first payment. Same applies to the Transitional Protection because they would need the final figures from Tax credits and ESA before they can calculate your TP entitlement.

    What was the reason why you were claiming Income Support? Was it because you're a carer claiming carers allowance or because you have a child under the age of 5?

    Yes sorry my mistake 29th May! The child element is correct and the basic element till I've been assessed for lcwra. I am with a housing association and was on Income Support for a child under 5

    Thank you. This makes sense so for your housing element, if they are not paying your landlord directly then the reason why it wasn't included is because they most likely haven't been able to verify your liability yet. Hopefully your UC will be recalculated quickly and they will pay the remainder of what they owe.

    Have you reported your health condition and provided a fit note? You must continue to provide fit notes until a decision is made on your work capability assessment. Are you also aware that if found to have LCWRA then it will mean your TP will erode by the same amount, therefore you may not be any better off.

    Yes I think you're correct as they have put in my journal this morning to contact my landlord and ask them to verify my housing details on there universal credit rent portal ASAP. They have ignored everything about the other money so not sure how long I will be waiting for that? I understand I won't get more on LCWRA if allocated it I guess it saves the headache of all the fit notes but I'm still awaiting the forms.I have provided 4 months worth of sick notes so far so will keep getting them until a decision is made. I guess the only good thing is once my money is sorted if they deny me of LCWRA I'd assume I won't get less either but hopefully that doesn't happen

    The problem with Transitional Protection is that UC can't calculate it until they have all the figures from Tax credits and Income Support. I know that Income Support and UC are both part of UC but their communication between each other is very very limited. I know this may seem odd but it seems to be the norm that TP isn't calculated until after your first payment.

    Hopefully it will all be sorted very soon.

    Thanks for your time and messages! Seems my complaint I made Monday has ended in me receiving 2 phone calls today and 5 journal messages, still waiting for it to be sorted but at least it has been acknowledged and the ball is rolling now!
