I have both LCWRA and PIP.

I suffered complications from a stroke.

My work sent a wrong payment including all of my wages when I no longer get paid by them. This resulted in my loss of all UC payments. I have said I can pay back half using the 6 months holiday I was entitled to.

However they want it all.

At this time I am not capable to work.

So do I have to keep getting fit notes until my next 6 months holiday entitlement is up.

If I resign they will ask me 50% of the payment back. This is adding to my issues.

Hey there @brightsea and welcome to the community.

I'm afraid I wouldn't be able to answer that question as I don't know a huge deal about employment law. I'd suggest giving ACAS a call as they're the experts in disability employment law. I hope you can get this sorted out asap, the added stress cant be fun.

To be clear can you please confirm how many months of earnings you received incorrectly from your employer! And how many months of UC payments were reduced to zero?

So far 1 month UC and 1 month wages.

Not sure how you got tagged.

I used to be good with all these things.

You didn’t previously tag me in your other comments, until now. The message you see on my comments is something that appears in every comment under my signature.

Ok so it’s just one UC payment that was reduced. In your first comment you said all payments which made it seem like it was more than 1 month.

If your employer has reported incorrect earnings to HMRC then you need to contact your employer to put that right.
