MR
Hi, yesterday I got my letter refusing my pip application, dated 27th June, I have been on holiday. Zero points across the board, it says because I drive I have upper and lower body movement and core strength. So I rang to start th MR, I thought that was for them to send me a form , no we went through all the questions on the phone, I was ill prepared for this so I probably won't have got all my points across. Do I start preparing for tribunal? Or is this being pessimistic?
My conditions are cold, type 2 diabetes, arthritis in both knees, ankles and feet, hoofs syndrome in right knee, anemia, hypertension, costachondritis. Last year i lost a kidney in surgery. And a heart attack 19 years ago.

Hey there @Tee60 and welcome to the community.
I'm sorry they didn't award you any points. MRs aren't often overturned, but there's always a chance, so I'd not panic too much just yet. Tribunals are actually easier going that the actual assessments, so you have nothing to worry about there. PIP is less about any diagnosis and more about how your ailments affect you daily.0 -
Hi @Tee60
Because you've only just registered your MR you've got time to now prepare extra information to send in with it before the new decision is made.
You can reiterate why you're entitled in a letter to the DWP for the attention of the decision maker as well as send in further evidence, you can do this at any time
With your health being complex you might find keeping some diaries from the CAB website first will generate evidence which you can send in, and then using the diaries as a starting point to go through the actives with the diaries to back yourself up.
https://www.citizensadvice.org.uk/Documents/Advice%20%28public%29/pip-diary.pdf
I'd try and do a few days of these unless you've have varying days in which case I'd do more.
Then I'd read through the descriptor list on the Cab website
https://www.citizensadvice.org.uk/Global/Migrated_Documents/adviceguide/pip-9-table-of-activities-descriptors-and-points.pdf]
Then I'd go through and write for each of the 12 which applies and why, using the examples in your diaries and writing a more detailed paragraph telling a story about you're affected and.
It's more important that you focus on why you qualify for the relevant descriptors.
Further, you could also do a SAR to your GP for records which you could send in. An SAR means a subject access request. To get a copy of information held about you.
You could also send on in to the DWP to get a copy of the assessors report and other information the DWP hold to see in more detail how they came to the decision. You can go on to the gov uk website and search DWP SAR and ask DWP for copies of what paper work they have that you'd like. You don't need to give a reason and its a totally separate department which deals with these requests.
You can ask for a 'complete copy of their entire records' or something more specific. It doesn't usually come quicker if you ask for less and sometimes they can miss stuff off, but if you ask for everything they have, then that will answer the question as to how many reports there are.

Hi, I have just rang for a copy of the medical assessment.
I use a walking stick, on advice from physio, a extra handrail on the stairs, a shower stool.
So I was really shocked it says because I can drive it's a similar range of movement to accessing a bathtub and indicates a level of functional ability in relation to daily living tasks! I don't bath i cant get in,I shower.

I thought a MR went to a different person re look at.
Flour suggested that I write a letter reiterating the reasons , for the attention of the decision maker.
Could IPhone and ask who is looking at my case and send the letter to them ?

The MR will be looked at by another decision maker and not the same person that made the original decision.
It is always advised to put the MR request in writing and not ring to request it because how do you know the person in the call centre is typing what you've asked them to do.
They won't be able to tell you the name of the person that's looking at your claim and you don't need the name of the person to request the MR. Just write a letter stating where and why you think you should have scored those points.

Thanks for clearing this up for me poppy.
When I rang I was just expecting to ask for the form, but she went through the questions and asked if I agreed or not and why not and then typed the answers. I wasn't prepared for that.
I will write a letter put my name address NI number etc and hope it gets forwarded to the relevant person.

Make sure you that state clearly that you are requesting the MR. It will be sent added to the system and then sent to a decision maker along with rest of your file.
