Pip and Change of Circumstances

I wonder if anyone can throw any light on this. Many years BEFORE pension age, I was awarded High Rate DLA and Low rate Care. In 2019 I was transferred over to PIP as I had no choice but I was then over pension age. nevertheless I still got Enhanced Mobility and Standard rate Daily Recently my circumstances changed and I informed DWP. I was awarded Enhanced Rate Daily Living but they said they couldn't award Enhanced mobility due to my being over pension age when circumstances changed. The crux of the matter is my mobility has always been the same. It's always been less than 20 metres. It was my care needs that changed. They said they would have offered me the higher rate but the guidance doesn't allow it. Is this true? Does anyone know?

You already had Enhanced mobility before you reported changes so yes that could be awarded again. If you didn't already have that award then they couldn't award it after state pension age.
I'd advise you to request the Mandatory Reconsideration on that decision. Tell them that you already had that award before you reported changes and your ability to walk hadn't changed. If the MR decision doesn't change the award you can proceed to Tribunal.

Thank you so much for this information. I certainly read that it was the case that you could not increase standard to enhanced but I wasn’t sure about what happened if you were already on enhanced. I will request a Mandatory reconsideration and go to the level of tribunal if necessary.

You’re welcome. It really doesn’t make any sense to not award it due to your age when you already had the award to start with.

I agree with Poppy, their reason for not awarding you Enhanced Mobility doesn't make sense. You had it before. I would certainly put in an MR, explaining the reasons why you should receive Enhanced Mobility.

It really is a shame to be waiting so long, I personally don't like the waiting. I hope it's somehow faster than 15 weeks, but best of luck with it 🤞
