Hi I really need some advice my partner has stage 4 copd he's awaiting lung reduction surgery we have been fighting pip since last year they lied on there report saying he can walk over 100 meters when he can't they say he cooks food without being breathless and does housework which obviously he doesn't as I do everything for him as he can't physically do it without getting exerted. Today we've received a court date for next month by telephone. I have sent them as much evidence as possible I also sent them the 6 min walk test it does say sats dropped to 92 patient was exerted and managed 1.2 meters at slow paced with exertion not sure if this is gonna help the in the court case just getting stressed out with the whole situation originally on pip he was 1 point off low rate daily living and he was awarded the low rate mobilty as they Said he can plan a journey but again I told them he can plan a journey but physically he wouldn't be able to do it on his own at all with the breathlessness he gets he doesn't go anywhere on his own he only goes to hospital appointment which I attend with him b

Planning and Following a journey will not apply to him if he only has physical conditions. This will only apply to those with mental health, cognitive and sensory conditions. Physical conditions apply to the moving around part.

Make sure you fully check through the bundle before the hearing to check everything is there and have that with you during the hearing. He will be expected to speak for himself during the hearing unless you are his appointee.

Please don't be too alarmed if he doesn't have the decision on the day. Sometimes they can't make a decision during the hearing. If this happens he will be sent a decision letter within a few days. If you've been able to track the appeal online you can log into there a few hours later to see what the decision was and you should be able to see it. Good luck.

Hi thank you for your reply. Yes I am his appointee. I've gone threw everything they've sent us highlighted all the bits I disagree with. Really not getting my hopes up just think he's gonna be turned down. They said he can walk 100 meters on the old report which I have no idea where they got that from and me sending the 6 min walk test states he only managed 1.2 meters due to distress don't think it looks good me sending that
