Firms OOC Health contradicting my doctor

Hi, my Dr diagnosed me with Fibromyalgia, as well as stress, arthritis et Al. However the firms OCC Health, has basically said it's treatable with X Y AND Z. I feel like I'm getting pushed back into work, where I know I will struggle. I've asked for a 2nd opinion, and my union is doing a lot. Anybody know what the GOVERNMENTs view on this is???

Welcome to Scope. I am really sorry to hear about the health issues you are facing. It is reassuring that you have the support of your union.
If you have received a clinical diagnosis of fibromyalgia, it is recognised as a disability under the UK Equality Act 2010. This entitles you to reasonable adjustments at work and protection from discrimination. Only your GP can determine when you are fit to return to work. If you feel pressured to return before you are ready, you should have a detailed discussion with your GP. They can assess your condition and, if you are not fit enough to return, issue a fit note advising you to refrain from working. Depending on their findings, they may suggest a return date or recommend any adjustments needed to accommodate your disability.
If you believe that your employer or OCC Health is not adequately considering your condition, continuing to work with your union can help ensure that your rights are upheld and that you receive the appropriate support.

Thank you. The OH, has basically overruled my GP, as a previous consultant report some 6 months earlier and looking for Lupus, was a bit inconclusive. I have appealed, so we will see. Going back i don't see as a option, due to my condition. Things had previously been done to help, but can't imagine them putting up, with flare ups, physio, doctors on a regular basis.
Will keep in touch.

OH are a nightmare, despite all the "independence" talk, they are paid under contract by your employer.
I would also point out unless she can prescribe treatments and has a recognised qualification who are they to tell your Doctors how to treat you!
Appeal appeal appeal, id be tempted to ask for there clinical qualifications and experience, did they do a video call /telephone/ face to face assessment? Did they do any form of physical examination or ask you to perform reasonable work related activities and assess the impact if you could do, or record those which were impossible.
Did they ask how it affects you at different times of day, week, month? Good /days Vs bad days.
If not then the assessment is really irrelevant and a good union should be able to have it excluded and redone by a doctor or appropriate specialist.

Cheers K, the independent report was formed following evidence and another telephone call from works OH Dr. No physical was ever done by work. Nothing has been taken into account except her opinion on my condition. I have pointed that out to my union. I now sit and wait.
Regards.
