    I first applied for limited capacity on the 22nd April as I was referred via universal credit. (20 weeks ago)

    I had my telephone appointment on 11 June 2024 (that's 6 weeks since I was first referred)

    It is now 09/09/2024 (12 weeks and 6 days ) and I still have not heard anything, I did ring them and was told it was passed onto the DWP, but that was about 3 weeks ago and he did not tell me when it was passed onto the DWP.

    So my question is, when does the 13 weeks start from?

    Is it 22nd April or is it 11th June,

    I'm afraid I'm still learning all the technicalities of LCWRA, so I'm afraid I cant give you a firm answer either, but hopefully one of the community will be able to give you a definite soon. 😊

    Thank you for all your comments, I ended up waiting 16 weeks but I was awarded Limited capacity at work.

    Am I right in saying that I will now get a work allowance, which I can work part time up to £400.00 a month and I will not lose any of my universal credit.

    I also get industrial injuries which is paid weekly but these payments are taken off my universal credit but now I have the limited capacity at work will this be included in my work allowance so universal credit do not take industrial injuries payment off my universal credit

    If the decision was Limited Capability for work (LCW) you will not receive any extra money each month for that. You will only receive extra money if the decision was Limited Capability For Work Related Activity. (LCWRA) Please check exactly what the decision was.

    You will still be entitled to the work allowance for either of those above. However, the work allowance applies to earnings and not to "other Income." Your IIDB (Industrial injuries) is not treated as earnings, it's treated as other income so it will still be deducted in full from your UC as it always has been.

    If you claim for help with the rent your work allowance will be £404/month, if you don't it will be £673/month.

    You're welcome. If you disagree with that decision and think you should qualify for LCWRA then you can challenge that by first requesting the Mandatory Reconsideration. (MR) You can do that on your journal and you'll need to state which descriptor you think applies to you and why.
