Loss of transitional protection due to move from Northern Ireland to Scotland

Hi everyone

My name is Aiya and I need your help please.

I'll try to keep this as simple as possible.

On 29 August 2024 I moved permanently from Belfast (Northern Ireland) to Orkney (Scotland)

I am on

ESA (support group)

PIP (middle care high mobility)

HOUSING BENEFIT

I'm being told now that I can't make a new claim for housing benefit.

Instead I have to voluntarily apply for UC

Which means I lose any transitional protection.

In my case that's £200+ per month.

Is there any help I can get to offset this sudden drop in income?

I have spent all day yesterday and all of this morning trying to get a sensible answer from someone, anyone at DWP, UC and Orkney District Council.

    @aiyamadsen You have moved from one Country to another.

    If I moved from one landlord to another, then you lose your transitional protection.

    So I could not move from my current landlord, to a new landlord in the same town.

    I could move to another town, as long as it is the same landlord and also the same council.

    Anything other than that, you lose your TP.

    Hope this answers your question, you lost all your managed migrated rights by moving.

    This is not correct, I've advised you on this before. Moving house in itself is not something that would end TP. It will only end if you either go from single to joint claim, joint to single or you become entitled to another element or another element increases which would mean the TP decreases and could decrease to zero.

    In this case here, the reason they need to claim UC in the first place is because they are moving to a different local Authority so it would be natural migration and not managed migration. Therefore there will only be entitlement to Transitional Protection if their ESA includes the SDP and they still meet the criteria for this when they claim UC.
