Hi I applied for incapacity to work on universal credit in may I was refused as was my mandatory reconsideration this is now going to the tribunal if I win will my payments be backdated? I have also been told my previous win at y pip tribunal should have been considered when I applied for incapacity to work is this true?

    If the Tribunal find you to have LCWRA then this will be dated from the date you provided your first fit note. There will then be a waiting period you need to serve before the extra money is paid. This period is 3 full assessment periods starting from when you provided your first fit note. The extra money is then paid from the 4th month, with first payment being the end of that 4th month.

    PIP and the work capability assessment are different. (though there is some overlap with some descriptors) Being entitled to one doesn't automatically entitle you to the other. For this reason they don't usually look at the other benefit.

    I find some of the examples ridiculous like for learning disabilities it says about learning new tasks they've said turning a TV on and using a remote control a more difficult task getting money out a cashpoint

    I agree @Bobbin77, some of the things that they suggest are ridiculous. Often they also assume everyone is the same, when our conditions and capabilities are all different. Even within a condition there can be a big variance in how people are affected.
