Universal credit son turning 3
Hey all
My son is turning 3 in nov uc known I'm disabled and hubby is getting carers though uc for me.
On the uc info page it says they will expect you to look for work once the child is 3
If I'm known disabled to them how quickly will they be on this will they auto try to get me looking for work or will they first contact me and ask about work capability?
I'm absolutely terrified as I cannot work I just can't...
Im on standard both pip I should be on higher mobility pip but I couldn't face the fight
I'd rather them just leave me be and stay on what we're getting I'm not out to get all the money going I'd just rather they not expect me to work and get the carers and child element.
I hate this had they left child tax credits alone I'd be left alone
Multiple disabilities, chronic fatigue and pain, adhd under ref for asd, severely reduced mobility and currently working towards funding and supprt for a wheelchair. Anxiety , depression.
I can't face being preasured and made to feel how they do
Just this not knowing when they are going to rock things is awful

Have you ever had a work capability assessment for UC or ESA at all? Or only been awarded UC since having your child?
Unfortunately it's not enough for them just to know that you're disabled, the extent of work limitations from your conditions will need to be proven through a WCA.
If you've never had a WCA before, you will need to report your health conditions to UC when your child turns 3, and provide a fit note from a GP. That will start the process towards getting a WCA.

Hey @Laura Bradshaw, welcome to the community 😊 As OverlyAnxious mentions, have you ever had a WCA before? If not I would look into the process of a WCA, it is another assessment but it comes with similar appeals processes that allow a tribunal to look over the decision if you think the DWP has made an incorrect decision.

The day your child turns 3, UC will be notified to arrange a new Commitments appointment with you. At this they will set your work commitments which will likely include work search at this stage.
When you applied for UC, did you report your conditions on the questions that ask about health? Unfortunately as your child was under 3 the UC system will not have flagged for you to start submitting fit notes. It is a shame this was not done sooner and many people fall into this same trap.
I would advise you to start the Work Capability process as soon as possible, this week if you are able. To do this you will need to have your GP provide you with a fit note, and continue to submit fit notes to UC until they complete a Work Capability Assessment on you. It's important that there are no gaps between fit notes.

We're getting carers wel my husband is getting carers for me via uc so we have declared disability. But haven't done wca before as we only changed to uc in feb

Will they realy be that hot on it? Straight away? I'm already sturggling atm... I am not going to cope well with this at all I feel sick
I'm going to have to book extra sessions with my therapist... I'm do fed up with all this disability benefits fights

Also sorry for posting again (I'm up with a poorly toddler!) My husband works full time and it's a couples claim does this make a difference?

I hope the little one feels better soon. Once he's 3 then yes you will likely need to attend an appointment with your work coach.
As advised earlier in the thread, you really need to report your health condition and provide a fit note from your GP within 7 days of that. This will then start the work capability assessment process off and you should be referred for the assessment around 29 days later. Please see link for more information.
To report your health condition, you need to log into your journal and report a change of circumstances. The look down the list and click "health" and report it through there.

The thing is I'm confused as I've also read on the uc site that if a couples claim if the joint administrative earnings threshold is reached which it says can be reached by just one partner then the other may not have to work
It's all confusing as some have been asked to do light stuff, some not at all from what I've seen on threads online... so I just don't know

Does your partner work? The AET doesn't apply to benefit income.
From the WCA, there are two different groups that you can be put into.
The first one is LCW - this one is where you are expected to do some light tasks towards getting back into work. It does not pay any extra money.
The second is LCWRA - this one is where you are not expected to do any work related tasks at all. This pays an extra £416.19 a month.

Yes my partner works I'm so confused now as some say I'd still have to work other say I wouldn't...
I'd rather stay on what we are and not work and just meet the aet
I don't want to do lcwa as pip is traumatic enough

It was decided last year for the AET for couples to be removed at some point in 2025. The current Government have not yet announced their plans as to whether they will continue this or not. With this in mind it is advisable to start the work capability process.
You asked previously how quickly they will approach you about setting new commitments. The day your child turns 3 an action will flag on Universal Credit's side assigning you a work coach and notifying them to arrange a commitments review with you. They do have to give you notice of these but they will look to do this as soon as possible.
Does your partner currently earn over the couple's AET?

I'm reluctant to go through another battle like I have to with pip... I have read how people have been treated with capability assessments and I just don't want to go through it… when I had my pip assemsent it was horrific the assessor and writen assemsent telling me that despite what I was saying my parenteral was saying my 4 specialists were saying that they beleived I was more able they ignored so much of what I said and said they thought I could do things I couldn't despite having evidence and witness accounts of me not being able to they belittled me and made out like i was lying or exagerating i had to fight for my pip … it made me ill and right now I'm in a bad flare up and the thought of facing all this for lwca is horrific ..

The majority of people are found to have LCWRA. I've been advising on here with benefits for 7 years and one of the most common questions is "I've been awarded LCWRA, when is the extra money paid from"

The process of Work Capability Assessments and obtaining LCWRA is not great and has many issues, but is much nicer than the sanctions and harrassment to find and search for work you may face as the alternative.
If you do decide to go through with it, you can request a paper based assessment. They do not have to accept the request but explain how unwell your PIP assessment had made you and how much that impacted you.

If you can push through the process, the worst outcome is that you end up in the same situation as you are in currently. The best outcome is that you are awarded LCWRA and are then left alone by UC and your income increases too as a result. Almost 2/3 of all WCAs result in a decision of LCWRA.
