PIP Review Benefit Claim Ended Advise Needed

Hi All,

Back in 2018, my DLA benefit was ended and I was assessed for PIP which was unsuccessful.

I appealed the decision and thirteen months later in November 2019, I was awarded PIP.

Jump five years on and today I received my PIP review decision letter.

My PIP claim has ended and I no longer qualify for the benefit, despite suffering from Cerebral Palsy from birth.

I have already downloaded the following form if-you-disagree-with-a-decision-made-by-dwp.pdf.

Please can someone confirm, if this is the correct page and form that needs filling out?

Also regarding medical evidence, for the tribunal stage, what should I submit for evidence?

As I submitted my entire medical history the first time around when I appealed back in 2018.

My Cerebral Palsy and health overall hasn't changed.

Back in 2018, I also got advice from the citizens advice bureau, would it be worthwhile me seeking support and advice from them again?

I have also kept all the evidence from last time around.

    Hi @Adam____F - yes, you can use that form, or you could just write a letter (putting your name & National Insurance number on each page). A Mandatory Reconsideration (MR), as this is called, is the first stage in appealing a decision, a tribunal would be the next stage after that, if needed.

    Remember PIP is not about any diagnosis, but rather how your disability affects certain activities of daily living &/your mobility the majority of the time. Have a look again at the activities/descriptors that are looked at:

    With your MR you should say where you think you should have got points, & why, giving a couple of recent, detailed examples as to the difficulty you face for each applicable descriptor, i.e. when did it happen, where, what happened, did anyone see this, & were there any consequences to attempting/doing an activity?

    Say if you can't do an activity 'reliably,' i.e. safely, to an acceptable standard, repeat as often as one would reasonably expect, or if it takes you much longer than someone without a disability. See this mentioned at the end of the link above.

    You don't need your entire medical history. You should only send what's relevant to the PIP descriptors. If I sent my entire medical history the amount of pages would literally be huge and a lot of it wouldn't even be relevant.

    You should look through it and see what's relevant and what's not. Sending multiple pieces of evidence all saying the same thing isn't helpful either. Less is very often more.

    For the MR I'd also advise you to send the Tribunal decision letter with it, if you still have it.

    I don't think that is the tribunal decision letter. That looks like the DWP's response to the tribunal.

    The one you need should be headed up with HMCTS, not DWP.

    Yes, these are the 'consequences' I mentioned in doing, or even attempting, any applicable activity, & could be anything from fatigue, breathlessness to an increase in pain.

    PIP is above all a functional assessment of a claimant's ability to 'reliably' do the activities/descriptors that are looked at.

    See if your local council has a welfare rights department they off the best help, failing that you should contact the Citizens Advice and ask for someone to represent you.

    That's impossible to answer because I can only see a very small amount of the letter you've linked to.

    If it's the Tribunal decision letter you're looking for then that's not it.
