Hi I have just been passed for lcwra 4 weeks ago I handed my declaration In on the 4th of January my job coach says am not entitled to any backpay but I think I am canny ant 1 help please thanks

    More information is needed to be able to advise.

    1/ What date do you usually receive your money each month?

    2/ Were there any gaps in your fit notes up until a decision was made?

    3/ Is this your first work capability assessment?

    I get paid on the 11th of each month I got told 2 years ago not to hand anymore fit notes in I got put on lcwra 4 weeks ago and received my 1st payment on the 11th

    You didn’t answer my other question. Is this your first work capability assessment?

    If not and you previously had LCW and this was a review started by UC then the extra money will be from the assessment period in which the decision was made. In this case no money is owed.

    This was my 2nd wca and I have never gad lcwda or lcw before

    Then I’m confused why you stopped providing fit notes 2 years ago. If you were found fit for work in your first assessment then you should have provided fit notes for this claim.

    Gaps in your fit notes can affect when the extra money is paid from. It will be down to a decision maker to decide when the extra money is paid from.

    No my 1st assessment they said I was fit for work I won my appeal the tribunal recommended that I'm unfit for work but I didint get put in to any bracket ie lcwra lcw I then got a work questionnaire in Jan sent it away Jan got assessment 6 weeks ago passed for lcwra 4 weeks ago

    If the Tribunal decided you were unfit for work then you must have been found to have either LCW or LCWRA. As no extra money was being received at that time then I will assume that it was LCW that you were found to have.

    If you have the decision letter from the Tribunal please have a look at that because the decision on that will determine whether any money is owed here.
