Transitional Protection taken away
Hi.
Can anyone help please as I am confused by it all.
I moved this year and had to claim UC, which I really didn't want too, but I could no longer get HB, and council advised me that I had no option too. I was told I would get my Transitional Protection of SDP and had to keep chasing this via my journal. I was told last week: When we added a disabled child element in May 2024, this wiped it out completely.
Unfortunately my child has many health conditions too from birth, and I kept delaying applying for DLA for him because I couldn't cope with the stress as I was still recovering from a serious operation myself, I only did this after moving to a more suitable home for both of us. Is the above correct as Citizen advice told me this morning that it should only erode with housing costs?
It seems unfair. As It was only around 2 months when the disabled child element was added after I moved.

You were advised incorrectly by Citizens Advice. Transitional Protection erodes if you either become entitled to other elements or other elements increase. The addition of the disabled child element is correct in eroding the TP.
Had you started the DLA claim before you moved house or before you claiming UC then it would have been a different outcome.

@poppy123456 Thank you for the information. I am not sure why the lady told me differently at Citizens advice but maybe she got confused to what I was telling her. If I had known it before I moved I would have made the claim much sooner, but it is just one of those things. I am not very good at it all and I kept putting it off, which was my own fault I know.
