No, you won't be worse off but you won't be better off either. Your TP will erode by the same amount as the LCWRA element. Same applies when benefits increase next year.

Erode means exactly that. Yours won't erode completely because your TP is more than the LCWRA element.

No problem. That's because you would only usually see it when benefits change, for example, it applied when people moved from Incapacity benefit to ESA. Only this time it's worse due to housing element being included in UC.
Then your TP erodes completely and you'll be better off by the difference in the TP and LCWRA element.

Makes me wonder if it was worth applying for LCWRA now if we won't be any better off.

The only problem I see with that is that you could be expected to look for work, unless you're a carer claiming carers element. As a carer you have no commitments anyway.

I don't think our TP is much more than LCWRA so I suspect we may not get alot of TP if partner gets LCWRA

Are you claiming UC with a partner? Do you both claim carers element or just yourself? If it's just yourself, is it your partner that claims the disability benefit or a child?

Are you claiming UC now? LCWRA element is £416.19/month. If you're not claiming UC now then which benefits are you claiming?

We get UC now, migrated over in July from IS and CTC.
Partner gets PIP, I get CA. We have 1 child on the claim (15yo).
Partner just did WCA on Saturday so waiting for the decision about that. Our total UC at the moment including TP but minus repayments for an advance payment is 1502

Yes, joint claim. Hubby is a Carer to one of our sons and I am Carer to the other. I don't have an official Carer.
Our sons are adults so they get UC too. Both receive LCWRA element.0 -
@poppy123456 partners had a message on his journal, he's to have a work focused interview in January.
But he's not received a decision yet on his WCA.
The telephone appointment will be 6 months after we first claimed UC.
Is this normal?

Then my previous advice about the TP applies. If your TP is more than what the LCWRA element is then you will not be any better off if your partner is found to have LCWRA.
That's normal because no decision has been made on the WCA yet.

Thank you. This is not what I wanted to hear. This means once a decision is made on the work capability assessment if found to have LCWRA there's a double whammy. You will lose one of the carers elements and also your TP will erode by the same amount as the LCWRA element. Which means you'll be worse off. This is because the same person can't receive both carers and LCWRA element at the same time.
There was an Upper Tribunal hearing about this on 30th October. I don't know what the outcome of that was yet but once I find out I'll post the link.

Wish I had known. I would never have filled the UC50 out. Will wait to hear about the hearing result.
