Esa

quick question, I send of my ESA 50 reassessment form recently, and know there is a backlog ? I just worried that these new measures, with be brought in before I am assessed, as the parts they are take out, are my main point scorers, or will they say with the form I filled in ?

As we don't know what the changes will be or when they will be affected from it wouldn't be possible to answer that question.
All I can say is when changes take affect for benefits it's usually quite sometime before the changes are made law due to the process they need to go through first.

hi Poppy, I’m in the same boat, do you know how long they’re taking to process esa50 forms for legacy claimants?

There are delays with review decisions. There are people still waiting about 9 months after returning their form. Are you in the WRAG or Support Group?

I think I am in the support group

hi poppy, I’m in the WRAG group and I requested this review the other day because I didn’t want to be transferred to UC while I’m in the work group, I’ve been in this group for more than a decade but I’ve never been bothered by them or had to participate in any work related activities. However, when I do migrate to universal credit I should be in the support group and I have the medical evidence to back up my claim it’s just the process is so stressful. This is why I haven’t done it earlier. Do you think it was a good idea to request the review form to be moved to the support group. Also how long would this review take if I am in the Work group?
also, I read in a different thread that it was your birthday so happiest of birthdays to you and thank you for all your help. 💐🎂🥳1 -
Aww thank you for the birthday wishes, that's so kind of you. You could be waiting several months, possibly longer for a decision but it's just a guide, I can't really tell you for sure how long it will be.
Reporting changes now is probably a good idea if you think you should be in the Support Group. It means that if you are placed into that group you will be owed money from when you reported the changes.
If in the meantime you receive your migration letter and are later placed into the Support Group, which is LCWRA for UC then your statements will be recalculated from the start of your claim.
Good luck with the review and I hope everything goes in your favour.

thank you so much Poppy, so if I get my migration letter while I’m still in the process of the review will I lose my transitional protection? And also will they ask me to participate in work related activities if I do move to UC while I’m in the Work group, and if so will giving them medical evidence and telling them that I am in the process of the review make them leave me alone until I’m done with this review. Sorry if this was rambling i’m just so scared.

If a decision isn't made by the time you migrate to UC and you're later found to have LCWRA then any Transitional Protection you were entitled to will be recalculated due to your entitlement to the LCWRA element from the start of your claim.
Whether you'll be expected to attend work focused interviews will depend on your claimant commitments. LCW for UC is the same as WRAG for ESA. If you have problems attending appointments you can ask for a reasonable adjustment for telephone appointments instead. It will be down to a work coach whether they agree to that but they should.
