I was on UC with lcwra for depression and anxiety and I came back to my home country Pakistan after closing my previous claim on 16 September 2024.if I come back in uk in December and make a new claim so can I claim it without lcwra?

I don’t wanna get lcwra payment in my new claim because my condition is much better than before so can I make a new claim on UC but without lcwra?

Hi,
Yes you can make a new claim for UC. If you don't declare any health conditions then you will be treated as a job seeker and expected to be looking for work.

Oky if I didn’t mention any health conditions in my new claim so they will never start again my lcwra payment and just make my new payment according to my current situation in claim?

I am worried because my lcwra award didn’t have any expiry date on it and I am feeling better now so don’t want to take it in my new claim and don’t wanna face any assessment appointment so now what I have to do is simply make a new claim on UC and put my and my son details and they will start my payments without lcwra? Am I right ?

As you went out of the country for more than 1 month your entitlement to UC will have ended. This means that the LCWRA element will not be included with your claim. If you don't report your health condition then you'll be treated as a job seeker and will be expected to look for work.
However, if you do return and claim UC you may need to show you're Habitually Resident in the UK. For this reason reclaiming may not be straight forward. See link.

can we have to show habitual residence test if we are out of country just for 2 months for emergency?

is habitual residence test need is not when you spend more than 6 months out of uk?

I'm not sure where you got more than 6 months from but that's not correct. You could be questioned when out of the UK for more than 1 month. More information here.
