2nd property and UC

my husband and I are splitting up. We own a house together which we are both on the mortgage and I own a flat which is solely in my name.
My ex wants to move into my flat so he will then be paying the mortgage on that and I will no longer be receiving any rent or income from this property. I would then stay in the house with my children. However when I looked into getting help from UC it looks as though the flat is being taken into account and therefore im not entitled to anything apart from child benefit. I have 4 kids and worried how I’m going to manage. Can anyone tell me if my property could be disregarded in my case as my ex will be living in it and I won’t be getting an income from it? I’m so confused everything I read seems to be different?

There are some cases where the property can be disregarded. There's some information here that may help.

    https://www.legislation.gov.uk/uksi/2013/376/schedule/10

If none of those apply it's correct that if the capital in the property is more than £16,000 there's no entitlement to UC.

If it's put up for sale and you have proof of this then it can be disregarded for 6 months, longer if needed.

thank you. I’m a bit confused by what a lone parent is ? As in the link you sent it says this?

If former partner is a lone parent and occupies the premises as their home.

That refers to lone parent living with dependant children. As the children will be living with you, it does not apply.

Hey there @sophiewade and welcome to the community. 😊

I can see Poppy is already rushing to your aid and I don't want to intrude. I just wanted to pop in and say a quick hello.
