Work Capability Assessment waiting time and PIP

Hi , I’m waiting for a work capability assessment, I’m not sure how long this will be . I’m on UC at the moment and on a career break due to ill health through work related issues.

So my question is , if you fail the assessment and your still supplying sick notes what happens next ?

I’m unable to return to my role at work and I can’t foresee anything else my employer could offer me ref adjustments.

I’m nervous about the whole situation and have a phone call with my line manager in a few weeks to discuss my return even though I know I can’t return due to the nature of the job role and injuries I have sustained.

However I only realised my issues when i had to undergo hospital procedures and diagnosed that way .

I have lots of supporting evidence for my assessment and also wondered if it’s worth applying for PIP ?

    Hi,

    There are 3 possible outcomes from the WCA.

    1. LCWRA - No work commitments, no more fit notes, extra money.
    2. LCW - Some work commitments, no more fit notes, no extra money.
    3. Fit For Work - You will be classed as a job seeker and expected to provide evidence of regular work searches to keep receiving UC.

    If you disagree with the outcome of the WCA you can challenge it via Mandatory Reconsideration. If the award still doesn't change you can then appeal that at a tribunal.

    Waiting times differ depending on area so it's almost impossible to advise on how long you'll have to wait unfortunately.

    The criteria for PIP is different as it's more about daily life than work. I would recommend having a look at the PIP descriptors to see how many apply in your case. If you would score at least 8 points for either the Daily Living or Mobility sections then it is worth applying. The waiting times for PIP assessments are often much longer than the WCA.
