Severe dissability premium
Hi can someone advice me please I let someone claim carers allowance for my child . I get esa ect and I'm due to migrate to universal credit in 3 weeks I received a letter saying they've stopped my severe dissability premium. I contacted citizens advice before letting them claim carers allowance for my daughter is this correct or have they made a mistake

Someone claiming carers allowance for your child won't affect your SDP. Are you sure it was your child they claimed it for and not for you by mistake?
Does your child claim a qualifying disability benefit such as DLA mid/high rate care or PIP daily living?
What did the letter say exactly please?

Hi poppy thank you so much for replying to me the letter says dear me iro and my daughters name then says if they the person that is claiming carers benefit I will no longer receive servere disability premium . And its only the severe premium I will loose

Someone claiming carers allowance for your daughter will not affect your SDP.
Can you please confirm if you are the main claimant of the ESA claim or is it your daughters ESA in her name and you are her appointee?
I know you said she's your child but some people refer adult children as "their child"

I am the main claimant I am a single parent with a long term dissability. She is 14 and gets dla high rate care low rate mobility. I am not due to make a claim and migrate onto universal credit for 3 weeks the letter is from universal credit

Can you please tell me exactly what the letter says… word for word, leaving out any personal details such as names etc etc.
Sorry for all the questions but it just doesn't make sense that your SDP would be affected in this situation.

It says dear ..… IRO.daughters name .. we have been notified that ... cares for you for 35 hours or more each week .and is claiming carers benefit. If your carer is receiving a carers benefit. You will no longer be eligible for severe disability premium if you receive any of the following benefits. It is only the severe dissability premium that will stop.your other benefits will continue as normal

OK I think I understand this now. That letter is from Universal Credit and not from ESA, so it's not related to your ESA at all.
Does the person that's claim carers for your daughter claim UC their self? so it's Carers element of UC they've claimed and not carers allowance? If so then this is a letter that UC send out because someone has claimed carers element for your daughter. As she doesn't claim any benefits in her own right, nothing will be affected.
Most importantly your SDP in your ESA is not affected.

Has far as I know they have been awarded carers allowance and was getting universal but she said it will get deducted of her universal so she won't be better off

Yes it’s deducted in full from any UC entitlement so no financial gain to claiming it.
They can claim carers element of UC providing they are not receiving the LCWRA element for their self because the same person can’t receive both elements at the same time.

LCWRA is the same as ESA Support Group. No you will not lose your SDP because the letter isn’t about you, it’s about your daughter. It’s a standard letter.

Thankyou she is in the support group as she gets low rate pip as far as I know . She was told she would get 196 a month but as recieved 81 per week and had a back payment will she have to pay this back or get her universal stopped . I'm so relieved I'm not gonna loose anything Thankyou for replying to me

You’re welcome. She’s claimed carers allowance which is a separate benefit to UC. Yes, it’s £81.90/week. Yes, there will be an overpayment for UC because it’s deducted in full. The overpayment will be repaid back monthly and her UC will be reduced until it’s paid back.
It’s carers element that’s £198.31/month. However, as her UC also includes the LCWRA element for herself she will not be able to claim carers element at the same time.
