capacity to work benefit, backpay

afternoon, I wonder if anyone could help me please please bear with me as I have learning difficulties and struggle with spelling and grammar. I was signed off work by the doctor in June 2023. I submitted all of my fit notes to universal credits via my journal I asked many times universal credit if I was able to go on incapacity to work benefit in May this year I finally left my job as was too ill to continue. I continued to upload my fit notes to universal credit until July August when I was a told that I would have an assessment for incapacity to work benefit. I’ve been told I have been awarded and was told by an advisor on the phone that I would possibly be due some back pay due my first payment for limited capacity to work on the 12th of this month, but I’ve been told by universal credit advisor that I am not due any backdated money. Could someone tell me if this is true please as I’ve been informed by family and services that I should be getting backdated money until from my first fit note submitted hit someone please help me thank you in advance

    More information is needed before I can advise further.

    1/ please check what that decision actually was because you will only receive extra money if it was Limited Capability For Work Related Activity.

    2/ If it was that, what date exactly did you provide your first fit note?

    3/ What date do you usually receive your money each month?

    4/ Did you continue to provide fit notes the whole time without any gaps up until a decision was made on your work capability assessment?

    I have attached the letter below I was awarded limited capacity to work

    I provided my first fit note in June 3, 2023. When I was first become ill. I then lost left my job in May 2024 I carried on providing fit notes to universal credit until July this year when I was told that I would have an assessment.

    I receive my universal credits on the 12th of each month from the 12th of this month. I will be awarded the extra payment for limited capacity to work.

    I believe there is no gaps in my fit note, maybe the odd day or two, but consistently provided every month I have been informed that I am not entitled to any backdated payments

    The decision was LCWRA and not LCW. I can also see you've left some personal information on that letter, which you should have covered up or removed. This is a public forum and anyone can see your information. To protect yourself scope do not allow personal information.

    For this reason I have contacted the team who will remove the information in the morning when they start work. You will not be able to edit the comment and remove it yourself.

    Part of the rules are there must be no gaps in your fit notes up until the decision is made. Gaps can affect when the extra money is paid from.

    Can you please check how many gaps there were and for how long? You also said you provided fit notes until July but when did that fit note end and when was the decision made on the work capability assessment?

    Sorry for all the questions but sometimes it's not always possible to advise without more information. If there were gaps it will be down to a decision maker to make the final decision on when it's paid from.

    oh gosh, how silly of me thank you for making me aware and reporting it on my behalf. I have just looked at my fit note which I have screenshot it all was submitted to universal credit. I have consistent fit notes from 27th june 2023 until july 15 2024

    You're welcome. I can see that the scope team have edited your screenshots and removed the personal information.

    If that fit note in July ended on 15th, is there any reason why you didn't continue to provide fit notes up until a decision was made? I can see the decision letter was dated 30th August.

    Gaps in fit notes can affect when the extra money is paid from, which is highly likely why you've been told no money is owed.

    All I can advise at this stage is to put a message onto your journal under the payment section and ask about the LCWRA element.

    Thank you again for your advice, .I believed that i don’t have after having my assessment I assumed I didn’t have to provide any more notes. My condition didn’t change

    I was also in mental crisis and I struggle with my learning difficulties in a good frame of mind. I struggle to upload things or even get out of bed. I have the sicknote from the doctor. Is there anything I can do what can I get a doctors letter or something? Does this mean that I will not be issued no backdate it

    All you can do is as I advised and put a message onto your journal and ask them if you can provide a backdated fit note from when the last one ended. It will be down to a decision maker to make the final decision.
