Hi, my name is Aluminium! Am I no longer entitled to money for caring for my daughter?
Hi, I migrated from ESA work related benefit to Universal Credit.
I myself are severely disabled and receive LCWRA, I was previously receiving money for looking after my disabled daughter also which was included in my Statement. It was approx £200 pm.
What now, I’m hoping somebody can advise, am I NO LONGER entitled to this allowance for looking after my disabled daughter ?
If I was entitled to this before then WHY have the RULES changed regarding this Benefit ?

Under UC rules, the same person cannot receive LCWRA & Carers Element.

You said when you were claiming ESA you were in the work related group. Then mention LCWRA for UC. The work related group for ESA is LCW for UC.
Have you had another work capability assessment since migrating to UC? Or has a decision been made on a work capability assessment since you migrated?

hi Poppy sorry if I confused you. I was in the contributions related ESA previously. Now they’ve changed me over to ESA without contributions based c( whatever they may call it ) and I have been in the Support group for many years !

it’s so unfair. What am I suppose to do to help take care of my Disabled daughter when I’m severely disabled myself and have nobody else to take care of her ?

How old is your Daughter, and does she receive any benefits?

she receives DLA middle care and lower mobility

The rules haven't changed. It's always been the rules that the same person can't receive both carers element and LCWRA element at the same time. I'm confused why the carers element used to be included in your UC when it shouldn't have been. This is why I asked if you were in that group when you claimed ESA.
Regarding your daughter. Is she working? Or has she ever worked? If not and she's never claimed any benefits other than DLA she will also not be receiving any NI credits towards her state pension.
She or yourself should use a benefits calculator to check entitlement to UC for herself, in her own right. If she doesn't have capital over £16,000 there maybe some entitlement.

hiya, daughter not working and I was previously awarded Carers element/award with my contributions based ESA (old style ESA).

Carers element is part of UC and shouldn't have been paid to the same person that receives the LCWRA element of UC.
Or do you mean your ESA included the carers premium (not element) because your ESA was part Income Related? The rules for ESA are/were completely different to UC.

If that’s a letter for ESA then it’s carers premium.
When you migrated to UC if you were worse off financially then your UC should have included Transitional Protection.

Thank you for confirming that, it's what I thought. Unfortunately, UC are correct not to include carers element at the same time as LCWRA element.
Please also look into UC for your daughter because she could be losing out on money by not claiming it. She will need to report her health condition and provide a fit note if she does claim it.
