hi all,

wondering if anyone would be able to help.
me and my partner have just moved in together with our 3 children.
i am on lcw and he had an appointment at the job centre yesterday and they told him he’s not gainfully self employed. We are abit confused and unsure what this means. Will this mean the uc we are due to get will be lower? Or can anyone explain in simple terms what it means. We’ve heard someone mention a minimum income floor?

Thank you

Did they explain why they consider that he is not gainfully self- employed? Is self-employment his main source of income? Is he registered with HMRC as being self- employed? Did he provide any evidence of his self -employment for example invoices, bank statements, tax returns or records of customers, suppliers or contracts? How long has he been self employed and is he making any profit? You say that you are on LCW and that you have three children. Are you receiving PIP or are any of the children receiving DLA?

no they didn’t give a reason which is why we are confused. He is registered as self employed didn’t have to provide any evidence. It is his main source of income. But within his first year or self employment and not really making a profit at the moment he’s earning around £500 a month ish.
I have tried getting pip and told I’m not able to get it.

Who told you that you didn't need to provide evidence of self employed? When you're self employed and attend the gateway appointment you're supposed to take evidence with you to show the work coach. This can include things like invoices, tax returns, bank statements, receipts etc etc. You can see information here, including what to take with you for that appointment.

As he's not gainfully self employed he may have work commitments that he will need to agree to with his work coach. This may include looking for work and/or attending appointments with the work coach.

Your partner will still be expected to report their earnings and expenses on the last day of each assessment period.

When was the decision made on your PIP? Did you challenge that decision?
