ESA to uc

can someone help me please
I used to get £268.50 a week esa and housing benefit of £434 a month which is £1,163+ 434 =£1,597.00
Now i get uc as my son goes to college
So they should match what i was on which was £1,597 plus child element £333
But i receive
£393.45 standard alowance
£575.55 housing
£416.19. LRWR
£333.33 for a child = £1,718.52
so basically when my child leaves collage in may they will take £333.33 of me leaving me with £1,385.19
Ive been questioning this for over 12 mth and I keep getting fobbed of its hard for me to speak on the phone as i have C.P can somebody understand where im coming from and how can i take it to a tribunal im so stressed as no one is listening

The reason your UC includes the child element is because your son is still in full time non advanced education. This element would continue until 1st Sept following their 19th birthday if they continued in full time non advanced education.
If they leave full time education then yes your child element would stop because you would no longer be entitled to it, which is correct. What makes you think that you would still be entitled to it if your son leaves education?
Therefore, in your case there would be nothing to challenge because the removal of the child element would be correct.

Are you sure your ESA was £268.50 per week? That seems like an awful lot, even if it did include the Severe Disability Premium. Please check how much ESA you were receiving.

The figures you have posted for ESA & HB are weekly, UC is calculated monthly and there are 4.3 weeks in a month.
Muddies the waters slightly.
To convert a weekly benefit to monthly, you multiply by 52 then divide by 12.
Your UC entitlement at the time of transfer was:
Housing Element, LCWRA, standard allowance and child element.
Only after your UC award is added up (so including the child element) does the TP make up the difference from your legacy benefit entitlement if you are worse off. This is fixed at the time of transfer.
It doesn't rise again or get added later if your UC entitlement changes (loss of child element).
Many families see a drop in benefit income as a child changes from dependant to non dependant.

Did you move to Universal Credit under the Managed Migration process? You have provided a breakdown of your UC payment but this does not include a Transitional Element. Do you or did you earlier in your claim receive a Transitional Element?

The issue is, when you started claiming UC for you and your child, your total income was higher than it was on legacy benefits (ESA and housing), so there is no TP to be paid.

You removing the child element for when your son leaves full time education. Therefore it’s correct that your UC entitlement would be less when this happens.
Transitional Protection only applies when you claim UC through managed migration at the time you claim UC. It will not apply anytime after that.

That why I did put the monthly figures the letter I av from esa says £268.50 per week I get premiums on esa as well

It's not possible for your ESA to have been that much per week as a single person. As you were in the Support Group if your ESA included the Severe disability premium then your ESA should have been maximum £240.55 per week. (£481.10 fortnight)
If your ESA didn't include the Severe disability Premium then your weekly amount would have been £159.05. (£318.10 fortnight)
Those amounts were the rates from April 2024.
Did you live with other adults when you were claiming ESA? (including your own adult children) If so were they either registered blind or claiming either daily living PIP, DLA mid/high rate care or AA?
May I ask did you claim UC through managed migration? If so when exactly did you claim it?

I’ve just struggled like hell to speak with esa and here is a breakdown
ESA
Standard. 84.80
Premium severe 76.40
Disability premium 44.70
Enhance 19.55 =225.45
Career premium 42,75 = £268.20 a week = £13,946. Yr devided 12 = £1.162 monthly plus housing 109 week x 52 = £5.668 yr = £472.33 so uc should match this plus child element until he leave s

Those are the rates before April 2024. You didn't answer my other question.. did you claim UC through managed migration because you received a letter asking to apply? Or was it because of a different reason? and when did you claim?
We can't give advice unless you answer all of the questions.
Carers premium would only be included if you were caring for someone and you were either claiming carers allowance or had an underlying entitlement to it.
In a previous comment of yours from July last year you said you were also claiming ESA as well as UC, do you still claim ESA?

the £1718 is the money before deduction which is £598 esa So I receive £1,120 from uc and 598 from esa still

Managed migration would be when you receive a letter inviting you to claim.
If you claimed because of a change of circumstances it would be natural migration and the rules for this are different.

ESA is paid every 2 weeks.
UC is paid once a month. You can request an APA for UC to be paid twice a month, but as there are more than 28 days in most months, that will not be every 2 weeks exactly.
