Hi, my name is poppydad! records had been falsely recorded and they are paying me the wrong rate

My condition has worsened since being given payment for the next 10 years in 2022. After phoning for advice today It turns out the lady who came to my home Wrote that I can walk up the stairs and use the bathroom and bedroom My problem is i live in a bungalow and have done since 1997. The lady on the phone and her case manager said that my records had been falsely recorded and they are paying me the wrong rate They are sending me the forms out again. If proven and I win how long will they go back for under payment

    Hi,

    Which benefit is this for? Being able to walk up stairs isn't considered for PIP.

    The lady falsified the records to play down the claim

    Which benefit is this for? And which rate do you currently get?

    Being able to walk up stairs isn't relevant for PIP. If you currently get Enhanced Mobility rate then that is already the maximum.

    Hi I get the lower rate for both They are re-sending the forms back out again because the case manager says i have been paid the wrong rate

    Ok. There is room for improvement up to Enhanced rate in that case. Stairs are still irrelevant so don't just focus on that.

    It will be down to a decision maker to decide if any backpay is due, and how far back to go. As you're getting new forms this will be classed as a change of circumstances, and in most cases the backpay would start on the date that you inform them of the changes. However, if you can provide evidence to show that you should have been getting Enhanced rate in previous years, then a decision maker could award you backpay going further back as well.
