ESA migration with a disability
Hi, my son (aged 61) is profoundly deaf, has not been in employment and has been on ESA for a number of years.
He does not get any payments but I have been assured his 'stamp' is being paid whilst he is on ESA.
He has had no notification as to the way future when, I assume, his ESA will be stopped. Can anyone offer some advice please. Thank you.

An ESA claim for NI credits only isn’t actually a claim it’s just NI credits only. If he’s not claiming any other benefits he won’t be migrated to UC. His NI credits should still continue.

Sorry Poppy, I should have said he receives WTC through a joint claim. He also receives PIP.
When I had said he does not receive any payments I meant payment through ESA…😥 I should also have stated we are in Scotland (I'm not doing too well today!😂).

Has he received a migration letter yet? Tax credits are due to end for everyone on 5th April 2025.
If he’s in the Support Group for ESA and the NI credits are still continuing then he will be entitled to the LCWRA element of UC from the start of his UC claim. If he’s not sure about that then he can contact ESA to ask them.
If his PIP includes the daily living part then his partner will be able to claim carers element of UC for looking after him. Unless someone else is claiming that or carer allowance for looking after him and then they will not be able to claim it.

Many thanks Poppy. We are actually meeting this morning to receive assistance with their Universal Claim Form as both my son and his wife are profoundly deaf and, as written English is not their language, we will have a BSL interpreter with us.
Both receive 8 points under the 'Communication' section of the Statement of Entitlement for PIP, with my DIL also receiving 10 points for 'Planning a Journey'.
