https://www.gbnews.com/money/dwp-alert-labour-benefit-cuts-unlawful

they are still going ahead with the cuts even though has been declared unlawful what is the government above the law?

Hi @Dave1993 they've not said they'll be going ahead with the previous governments plans at all, I'd please be careful about the information you read online. I've found GB News hasn't been great for getting factual information from.

its on benefitandworks
at the bottom a government minister said
βThe judge has found the previous government failed to adequately explain their proposals. As part of wider reforms that help people into work and ensure fiscal sustainability, the government will re-consult on the WCA descriptor changes, addressing the shortcomings in the previous consultation, in light of the judgment. The government intends to deliver the full level of savings in the public finances forecasts.β

so they still want to go ahead with the 3 billion cuts to benefits

They've stated they'll be re-consulting over it and addressing the shortcomings, that doesn't mean they'll be doing what the last government wanted to do.
It's best for us currently to just wait and see.2 -
but they state this
The government intends to deliver the full level of savings in the public finances forecastsmeans cuts are going to happen and its not going to be good

But it doesn't say where the cuts are going to come from. So people need to be patient and not get caught up in all the name calling and finger pointing.

so it might not be cut from benefits?
