Regarding my recent post on my sons education and UC who have stopped paying him after 3 years and has a LCWRA i checked the government website.

Can someone on PIP apply for Universal Credit?

You can claim Universal Credit if you're in full-time education, and have been assessed as having limited capability for work by a Work Capability Assessment before starting your course. You must also be entitled to any of the following: Personal Independence Payment ( PIP ) Disability Living Allowance ( DLA )

So I don't understand why they are asking me now to claim on the student loan when he's only got a few months left and they've asked for money back for the first 4 months of his final year. It seems unfair to me to say they are closing his UC account with no warningand when I asked fora mandatory reconsideration they then decide that he owes them money. I'm his appointee for pips and have an appointment to be his appointee for UC even though they've only ever spoken to me anyway as my son has social & communication difficulties (Autism) apprantly they visit you're house. But has anyone else experienced this?

    In your other thread here you posted a screenshot for the decision of the work capability assessment. That decision is Limited capability for work (LCW) and not Limited Capability for Work Related Activity. (LCWRA)There is no extra money for LCW like there is for LCWRA. Kimmy advised you this in that thread.

    Yes, a disabled person who's claiming PIP and is a student can claim UC, this isn't the issues here.

    As I also advised in that thread, if there's a maintenance loan available then it affects UC, even if you decide not to take that loan. This means UC will be affected whether you take that loan or not and they will reduce the amount you're entitled to, just as if you took that loan. I'm afraid this is the law and this is how it's been for means tested benefits for many years.

    Disabled Student Allowances do not affect UC.
