With regards to a will that I am included in, I do not wish to receive any money upon the will makers death, therefore would could I contact the relevant individuals now and advise them that I wish to be removed from the will or will I have to wait till the will makers death?

    You need to tell the person now, if they die and you decline an inheritance that will be treated as deliberate deprevation of capital.

    Would only the person who has left me money in the will be able to remove me or could anyone else do so?

    It would need to be the person who has written the will.

    To ensure you're not included in the will, it's important to express your wishes directly to the will-maker while they are still alive. If you wait until after their death, you can only refuse the inheritance, not completely remove yourself from the will. Only the will-maker has the legal authority to change or create a new will, as long as they are alive and have the mental capacity (testamentary capacity) to do so. No one else can make those changes during the testator's lifetime.

    You need to contact the testator now. After death, the options are refusing the legacy or a Deed of Variation by which your legacy could be passed to another beneficiary, or person dear to to the deceased. However, both procedures would be deemed deprivation of capital by DWP. Act now.
