The first thing you need to do is write to the tribunal and ask for two things, the “statement of reasons” and the “record of proceedings.” These documents explain how they made their decision and what was said during the hearing. You have to ask for them within one month of the tribunal’s decision as they will not send them to you automatically.

Once you get them, read through the statement carefully (or ask someone to help you) and look for anything that seems wrong legally, such as if they did not consider important medical evidence or applied the rules unfairly. If you think there is a legal mistake, you can then apply to appeal to the Upper Tribunal.

Just so you know, this is not a quick or easy process. Proving a legal error is difficult and often needs help from a legal expert or a benefits advisor. Appeals to the Upper Tribunal can take a long time and do not always succeed.

If there is no clear legal mistake, you will not be able to challenge the tribunal’s decision. However, you can start a new PIP claim, especially if your condition has got worse or you have new medical evidence that was not available before. That is often a faster and more straightforward route.

If you do decide to make a new claim, make sure you thoroughly explain how your conditions affect your day-to-day life. The more detail you provide, as that is what they are looking for, the better they’ll understand the impact it has on you. They’re looking for how your conditions affect you, not just what is wrong medically.
