Using direct payments

hi everyone

I had asked the person looking at my case for direct payments to increase the hours that i get but she had informed me that she cant.

I asked her to increase the hours so i can have my pa next to me as i am uncomfortable around people i dont know while going to college and while in college, but she had told me that they cant fund this as it will be expensive for them and if i was to be approved for it then everyone will end up asking for this…


is this something correct or false?

    Hi @firat94

    That's not fully correct and she shouldn't''t have said that because your support should be based on your individual needs, not what others might ask for.

    If needing your PA at college is part of your care needs then they should consider it properly and not dismiss it due to cost or assumptions.

    You can ask for a written explanation or request a reassessment of your support plan or another meeting to discuss your concerns☺️

    Is there something about this i can read about online on a government website i can show to her as proof, so they can reconsider it?

    There is Care Act 2014 that states…

    A local authority, having made a determination under section 13(1), must meet the adult's needs for care and support which meet the eligibility criteria if—

    (a)the adult is ordinarily resident in the authority's area or is present in its area but of no settled residence,

    (b)the adult's accrued costs do not exceed the cap on care costs, and

    (c)there is no charge under section 14 for meeting the needs or, in so far as there is, condition 1, 2 or 3 is met.

    There is also The Care and Support (Eligibility Criteria) Regulations 2015 that specify that an adult's needs meet the eligibility criteria if

    • The needs arise from or are related to a physical or mental impairment or illness.
    • As a result, the adult is unable to achieve two or more specified outcomes.
    • There is, or is likely to be, a significant impact on the adult's well-being.
