Hi, my name is aqesh100! Has anyone had an earlier tribunal date without attending the hearing?

Hello to everyone, with personal independent payment has anyone went to tribunal hearing without attending ,i have been told by HMCTS that it could take minimum 6month is this true has anyone got any earlier date without attending the hearing? Cheers

Hi @aqesh100, welcome to the community. I'm not sure if asking for a paper based hearing would mean your hearing would happen quicker. I hope some of our members might be able to share their experiences on that one.
Is it the waiting time you're worried about or is an in-person or telephone hearing not possible for you?
Unfortunately the waits can be quite a few months sometimes, but I hope you're not waiting too long.

Thanks to your reply i also like to know i got email sent for reminder from hmcts to send any evidence is this auto email or its not auto email also i like to know fi i win pip award for example after 6 month i know that they will payback date pip award what about carer allowance because carer allowance dont pay untill is applied and we cant apply for carer allowance until we get pip award ? Cheers

Hi @aqesh100 - I can't say if your tribunal hearing would be any earlier if it was one where you didn't attend, which would be called one that is 'paper-based.' I doubt it.
What I can say is that these 'paper-based' tribunals are not very successful (just 5-8%), whereas with one where you agree to attend 'in person' that has a much higher success rate at the moment of about 70%.
You can change a 'paper-based' tribunal hearing to one that's 'in person' before your hearing. Now altho they're called 'in person' hearings, you can normally just have one at home with a phone call, & you can have someone else there with you to support you if you want.
It's way better to go with a phone call if you can.
I think the email from HMCTS will just be one that everyone gets as a reminder.
You'd need to be awarded either rate of the daily living part of PIP for someone to be able to claim Carer's Allowance for looking after you, as you know.
Do you get any other benefits, as sometimes someone claiming Carer's Allowance for looking after you can mean you lose money if you already have a means tested benefit & receive an extra disability premium with that?
Yes, Carer's Allowance can be backdated to the start of your PIP claim if this is successful so long as you claim within 3 months of getting your decision.

Statistics get released and they very clearly show a low success rate with paper based hearings.

It is known Paper based tribunals are less successful through statistics. It has been calculated out from actual paper based tribunals in the past. I don't think having a paper based will be any quicker either. You have been told it is at least a 6 month wait for your tribunal, but it could be up to 1 year too.... So keep calm and relax. Could you not attend your tribunal? They are run by professional people and most go well.
