Advice please if possible with regards to transitional protection/element…

Hello,

Oh well, just when you thought it was going ok, received info from housing benefit that they will help with the transition to UC, I’m assuming that's the two week run on? However, I’ve since received a note in my journal informing me that I’m not entitled to receive help with housing costs as my landlord(private rented) needs to be registered as a landlord! Which wasn’t a problem before, as I had a review last year of my HB award and the same tenancy agreement was submitted.

It also said that the tenancy agreement hadn’t been dated, which is has been! Anyway my question is if I’m down on the money that I receive from UC in comparison to being on legacy benefits, am I entitled to the trasitional element, because there is no doubt that I will be in receipt of less money being on UC! As there will be no housing cost element included. Any help/advice/feedback would be most welcomed. Many thanks in advance.

    Hi,

    I don't believe Housing Benefit is included in the Transitional Protection calculation, but I could be wrong there. Haven't come across this situation before.

    This doesn't sound right anyway though. Landlords don't need to be registered in many parts of the UK, so that shouldn't make a difference to UC at all. As long as you have an official tenancy agreement showing names, addresses, dates and costs that should be good enough. I would recommend appealing that decision with the expectation that they will pay the Housing Element eventually (though possibly not in time for the first payment).

    Many thanks OverlyAnxious, for your response, it is most helpful, the thing that got me was it was perfectly acceptable for my local council (i.e. tenancy agreement) when there was a review on my claim for HB last May and they didn’t inquire about my landlord being registered either, so yes it’s a bit confusing I live in Scotland so I don’t know if the rules are different. If housing costs aren’t included in my UC payment, my money will be greatly reduced in comparison to when I was in receipt of legacy benefits (ESA WRAG & Housing Benefit)and I will invariably be worse off on UC! It’s all rather confusing!

    Hello again,

    I hope that everyone is doing ok and managing to get through the migration process ok! I received a journal message today (8th of July) informing me that I have an appointment for the 16th of July, to ‘review my claimant commitments’ I was in the WRAG group of ESA I’m currently engaged in some work, which was accepted as permitted work under the old legacy rules! I work up to 5 hours per week earning £28.92 per hour, (health condition limits me to do anymore than this) as I said this is already known to the DWP. How will this pan out in my new claimant commitments? Will I be entitled to the LCW element of UC as I had been claiming ESA since 2011? Again, any help/advice/feedback would be most welcomed and thank you for listening!

    Yes you will be entitled to receive the LCW element (with payment) under UC.

    Does the message refer to New Style ESA at all?

    Good afternoon,

    I hope everyone is managing to stay cool during this extremely hot weather! I wonder if anyone could shed any light on this, I just received my P45 in the post today, is this a normal part of the migration to UC process? It does say on Part 1A ‘Date allowance ceased…’ so I’m assuming that this normal! Thank you in advance and apologises if this a silly question.

    Yes, it’s normal to get a P45 from ESA when migrating. You can just file it away somewhere safe

    Sorry but that page doesn't show which group you're in.

    Even if you're in LCW, the work coach can choose to turn off work search requirements.

    Thank you @OverlyAnxious for your reply, I do appreciate it, I was in the WRAG of ESA I was assuming that would carry over to UC, during the phone the WC said they turned off the work search facility, so if the notion takes them they can turn it back on again, even though I have limited capabilities, oh the joys!

    Hi,

    Yes, that makes sense. LCW is the UC equivalent to WRAG group. So you may still be expected to complete work related activities at the Work Coaches discretion.

    It is people with LCWRA (ESA Support Group) who do not have any work related requirements.
