MJ V DWP 035.

Hi, I have been waiting since February and have been paying back Money back dated since November. All this because I’m a carer who’s disabled and made to claim Universal credit which meant they made me claim LCWRA. The tribunal MJ V DWP deemed it unlawful, even so I’m still waiting. I have put below what a decision maker wrote to me. My question is, is this another delay tactic or am I getting Somewhere?.
“I am the Decision Maker working on your mandatory reconsideration. We are aware of the Upper Tier Tribunal ruling and are currently waiting for guidance from policy & legal to ensure all disputes relating to this are dealt with a consistent approach.
We have escalated this with Policy and aim to action your mandatory reconsideration as soon as guidance has been received.”

Hello Neil, and welcome to Scope.
Regarding your question, from what you’ve shared, it appears your case is on hold because the DWP is waiting for clear instructions after the court ruling. The good news is that once they get the documents and guidance they need, your case should be sorted out quickly. I do not think this is a delay tactic, they really do seem to be waiting for the right paperwork and instructions before they can proceed. Hopefully, you will not have to much longer to wait.

Hi thanks for replying. What is annoying is the DWP decided in March not to appeal the tribunal’s decision. So I think it’s long enough. I also think it’s ironic that the tribunal thought it is discriminatory what the DWP as done, creating hardship for claimants, but yet I’m still suffering hardship. Regards Neil.
