I have LCWRA and am not required to look for work. My partner is deaf and has Usher syndrome. He will have a UC health assessment appointment next week. If he scores over 15 points, what happens next? What's called that?

He will either be awarded LCW or LCWRA depending on where he scores 15 points.

No extra money is paid for LCW.

If you claim with him as a couple, no extra money will be paid for LCWRA as the maximum number of LCWRA elements payable is one in a couples claim.

Yes, both of us live in a household; we are a couple.

Right, if we are LCWRA elements, and what about the carer allowance or element? Or not need? But we not have one in UC. Before that we have carer allowance. A little confused. Sorry about it.

Carers Allowance is separate to UC.

A person cannot get paid for both Carers Element and LCWRA.

You cannot get Carers Element because you are being paid for LCWRA.

If your partner is entitled to both, the higher amount is paid. As he cannot get paid for LCWRA, he should be able to get paid for Carers Element.

    Good morning @Kimi87

My parents got LCWRA confirmed a few days ago. We both have LCWRA. We know it's the same price as before.

We know we can't get the carer's element because we both have LCWRA, is that right?

So we weren't sure where the carer's allowance is, already in ESA or TP?

Do we need to fill out a carer's allowance form or not?

See the images down there, double-check for us, please, and is anything missing or is it all correct? We don't want to end up making a mistake that causes a drop in money. We want everything to be done and to switch our minds off.

If you receive a qualifying benefit then your partner can claim Carers Element.

It's true the same person cannot get paid both Carers Element and LCWRA, but as your partner won't get paid LCWRA element he should be able to claim Carers Element (if you receive a qualifying benefit).

If awarded your Transitional Protection will reduce by £201.68 which is the Carers Element amount.

To claim, you need to log into your Journal, and use the Report a Change, caring for someone to apply.

Any claim for Carers Allowance would just see the CA deducted in full from your UC award.

As I've advised several times, the same person cannot get paid for both LCWRA & Carers Element.

You get payment for LCWRA so cannot get payment for Carers Element.

Your partner will not get payment for LCWRA, so should be able to get payment for Carers Element.
