Good day forum, I’m hoping on some insight as what I’ve looked at online just doesn’t seem concrete. And I’m not familiar with DWP myself nor based in the UK anymore.

My younger sister was diagnosed with a condition at birth, her mental health into late 20’s had taken an impact. She has several conditions/diagnosis’s. From 2017 she’s received (ESA income related support group).
But it’s only been noticed that she’s been missing Premiums ontop by a charity!

From what I’ve made out;

EDP only started on her award from 2022, but SDP stopped 2022 the same year. Q1) Is this correct? Do they replace one another? Is she entitled to a backdation of them both?

I’ve also read up on DP disability premium. Q2) Is she entitled to this premium also with SDP/EDP? And from when and until?

My sister does also receive PIP, high for both parts from 2016 and still today. Q3) Does this help with receiving any of the premiums?

The charity have contacted DWP with my sister but they seem very reluctant and procrastinating with any insight for many months now.

Q4) If she owed a backdation, will this be paid to her in instalments? or lump sum?

Q5) If we do not have any clarity what is the most “effective and result-able” next step to take about this - regarding DWP?

Q6) How will this all affect her request to also go to Migration Universal Credit? (apologies if I’ve worded that incorrectly).

ANY additional insight/info again is welcomed.

    I have exactly the same thing high pip for both and was in a support group and was getting severely disabled payment and disability income guarantee but now I don't the only part of my income related esa is the support group payment and if you ask about the SDP you where getting you get told UC don't pay that and because the have moved you to the new esa from income related esa they don't pay that as well it's a nightmare all you get is ask on your journal and you get the same answer to the question no matter what you ask it's like they are just copy and pasted the same answer to whatever you ask you can tell that not one single mp who come up with these systems as never had to go through the system as I now have a work capability assessment from the New ESA AND UC as the esa say it's because I have made a new claim and it's the same story from UC even though I was migration after there notice letter so how I have made a new claim as my head spinning.

    When you move to UC from both IR & CB ESA, this converts into UC & New Style ESA.

    As part of the process a telephone appointment is made for New Style ESA to agree to your commitments, same as you did with UC.

    This isn't a work capability assessment, unless you've been sent a UC50 form?

    If you had SDP before migration then this itself doesn't exist under UC. You should currently be getting Transitional Protection on your claim. TP is added if your total UC award is lower than legacy benefits at the time of transfer. This does erode over time as other elements go up or new elements are added to your claim.

    Hi there i no about the transfer protection I only get £12.50 a week on the new esa i get the support group payments but I don't understand how now there both ask and sent a letter about work capability assessment from uc and esa even though it's only just over a year that I had a assessment on my income related esa and had my assessment done for pip that tuck over 2 year's with the back log and I'm on the high care and mobility parts .

    That i will be having a WCA and I have called ESA and UC and they say they have know record of that even after sending them both a screen shot of there letter's and telling me that they will get back to me about this and never have after calling them 3 or 4 times and still not replying

    Limited WCA reassessments are still happening but in very small numbers, have you received a UC50 form yet?

    Perhaps it's a mistake if no one has a record of it - although that contradicts what you said earlier

    as the esa say it's because I have made a new claim and it's the same story from UC

    When you claim both UC & NS ESA, reassessment is done under UC, so first a Journal message is sent advising the form is on the way, then you receive a UC50 form.

    It's one form & one assessment, the result applies to both benefits.

    @Gerald I found this information about work capability assessments:

    "If you have been receiving Employment and Support Allowance (ESA), you will not need to provide medical evidence such as fit notes, or have a Work Capability Assessment (WCA) again if all of the following apply:

    • you move from ESA to Universal Credit without a break
    • you have already completed a WCA
    • you were in the ‘support group’ or ‘work-related activity group’ in ESA when you made your claim to Universal Credit

    You may need to have another WCA if your WCA is due for a review or your condition changes.

    If you were providing medical evidence on ESA before you moved, you will still need to provide medical evidence on Universal Credit  until you get a WCA decision."

    If any of these don't apply to you then that could be why you're having to have another assessment.

    I did none of them just got moved from income related esa to the new esa and uc then got a letter from them both about wca i sent them screen shots and in the post and they still say they did not send them it a joke this saying that my income related esa is stopping as they told me the same thing about incapacity benefit that was ending that was 13 years ago.

    Universal Credit is replacing six income based benefits including IR ESA.

    One of them, Tax Credits, has already ceased to exist with migration to UC completed.

    The others are due to end shortly, anyone still in receipt will get a migration letter by the end of this month, with a few months to claim UC.

    By December the vast majority will have completed migration, with the complex cases done within a few months of that.

    You can request an advance payment. This is a loan that will be deducted from your future payment, until it's repaid.
