Hi, my name is Kev. Can I have the bedroom tax stopped after my wife has gone into a nursing home?

Hi I have recently migrated to Universal Credit. I also get Esa and Pip full amount. I have Mobility and mental health problems It is a joint tennancy with my wife,Shona it's a 2 bedroom bungalow However My wife has dementia and has moved into a Nursing home permanently, although her name is still on the Tennancy agreement but I am being charged £14 per week bedroom tax i have a DHP but I've been told that it is not for long term use can I legally have the bedroom tax stopped my wife is 74 and I am 64 thanks for your time Kev

If you need regular & frequent overnight care from a non resident carer, you can apply for a second bedroom to be paid for via UC.
Otherwise the bedroom tax being charged is correct legally speaking.
Once you reach state pension age then you will need to claim Housing Benefit. They may pay your entire rent.
You could also consider downsizing to a one bedroom home. If you live in social housing you would get priority for a new property, and often financial incentives too.

Unfortunately, I'm not sure there is a way to get out of the bedroom tax until you reach state pension age. But it may be worth speaking to a trained benefits adviser to see if they can find a way through it:
