UC, New style ESA…

I do apologise if this question has already been asked but I’ve not been able to find an answer by searching the forum.
I work part time however due to health conditions my earnings have fallen below the UC AET a couple of times. This has now triggered appointments with a work coach. I asked my GP for a fit note stating altered hours but instead he signed me off sick for 3 months (I continue to work). I have just received a work capability assessment form and feel overwhelmed. Now I see there’s a benefit New Style ESA and I wonder if I should be claiming that? Will I have to do two work capability forms?
I worry this whole process will make my health worse. Also if I’m found to have no problems will that mean I’ll be made to look for full time work?

Hi,
You won't be able to claim New Style ESA unless you have worked enough to pay NI contributions in the past 2 years.
To answer the question though, the Work Capability Assessment is exactly the same for both UC & ESA, so you wouldn't have to go through 2x WCA's.
Yes, if you're found not to meet the criteria for LCW or LCWRA then you will be classed as Fit for Work and expected to be actively looking for more work.

If someone is claiming both UC & NS ESA, one form (UC50) and one assessment is done.
The UC50 form is identical to the ESA50 form used if only on NS ESA.

Thank you for your replies. And if my earnings are above the AET would I be left alone? In that I wouldn’t be expected to work more hours?

Yes, the AET is the minimum expected from a claimant considered Fit for Work.
