pip mandatory reconsideration letter received too late to appeal

hello,

a young person with autism was waiting for the results of a mandatory reconsideration for pip

pip was contacted for a update and he was told that the letter had already been sent and has he had not received it they would sent another one out to him

the new letter arrived but the date on there is dated the 4th of may 2025 and it says on he letter that he needs to appeal within 1 month of that date. so he is 3 months too late to appeal.

he cannot understand very well how to contact pip to find out what he can do and he has no one to help him where he lives

i would have thought if they resent letter because the first one was not received that they would have put a new date on it? but i dont know how these things work

has he lost his chance to appeal. thank you

He can still submit an appeal, with an explanation as to why it is late. A decision will then be made whether to allow the appeal to go ahead.

I think a claimant has up to 13 months to appeal a PIP decision?

It's 13 months to start the process (Mandatory Reconsideration).

Then 1 month to appeal the outcome of MR.

Yes, you're right, it's also 13 months to start the tribunal process. I misread the initial post.

From what i've read you can't appeal an MR decision, the next stage is a tribunal (within 13 months). In that case being late 3 months doesn't matter. I checked here https://www.gov.uk/mandatory-reconsideration/if-you-disagree-with-the-outcome

He already submitted an MR appeal, the CAB link is to do this from a PIP decision.
