ESA IR TO UC MIGRATION

Hi,

I'd be grateful for some advice please:

My partner and I were in receipt if ESA (IR), My partner being my carer and receives CA.

I receive PIP (Both at enhanced rate).

We receive HB and CTB.

I was in the Support Group for ESA.

We completed the migration forms to UC, both completing them separately but have been joined together.

My partner was beginning to suffer with her own illnesses and disability so when my partner completed her UC migration form, these illnesses and disability have now been notified so in essence we are both now to claim UC as disabled applicants.

I was wondering if my support group status under ESA will migrate with me and also whether my partner should now apply to end her CA claim.despite still giving to struggle to assist me daily? Can they still continue to claim UC while also now applying to UC as unable to work because of their own ill ess/ disability.

Will we both be entitled to also claim the LCWRA premiums and if so how is this achieved? Will we both have to wait 3 months or will mine be migrated over to UC as I was already in the support group?

I don't know if we'll be better off under UC compared to ESA althoughmy partner will now be claiming LCWRA.

I'm.also unsure what now happens with HB as it ysed to be paid directly to the council.

I appreciate its a lot of information, but thank you in advance for any advice.

    As I understand it. unless your wife is in the Support Group she will have work commitments under UC … if she continues to claim Carers Allowance she won't.

    Only one part of a couple can claim LWRCA

    Your Support Group status will transfer with you and may or not be done in time for your first statement, mine was but it seems like a bit of potluck

    In my case I'm marginally better off under UC but lose a percentage of that as I'm now liable for 25% of council tax, as it seems most are in migrating

    I'm sure someone more au-fait will be along to confirm/shootdown … add to … what I've wrote

    Because your partner cares for you, she will be entitled to £201.68 for Carers Element.

    Carers Allowance is deducted in full from your UC award.

    The maximum entitlement for a couple to be paid is:

    1 x LCWRA

    1 x Carers Element

    As you partner is a carer she would have no work commitments. This isn't tied to Carers Allowance, she could be classed as your carer and receive CE without it, what qualifies her is you receiving PIP.

    She can go through the WCA process but it's rather pointless as:

    She already has no work commitments

    She won't be paid any extra money.

    Your ESA status will transfer automatically to UC.

    You can request Housing Element be paid directly to LL.

    May I ask is my partner still permitted to claim CA even though she is now disabled herself and do I need to inform CA that we have informed UC of her disability?

    I only ask as I'm not sure CA and UC speak to each other and don't want to leave it to chance as they may not and thus cause them to think we have not disclosed it later down the line?

    If she still meets the conditions of Carers Allowance such as hours spent caring for you, then there is no barrier that I see.
