Universal credit and carers allowance

hi not sure if my sister applying for carers allowance works with us receiving universal credit , I have lwcra , adp enhanced mobility , my husband is off sick from work on ssp and is still within the 28 weeks of this and he’s just had word that he’s been awarded adp standard living adp . He hasn’t had his medical assessment yet for universal credit his form was sent back a month ago . Question is will he go onto esa after the 28 weeks or will we both stay on universl credit. We are new to benefits so not sure how it works , I looked online and it says is someone claims carers allowance we would not receive any disability components in esa ? It’s all a bit confusing .

    The disability components with ESA no longer exist for new claims (IR ESA which has been replaced by Universal Credit).

    If your husband has applied for New Style ESA that will start after SSP ends, any award will be deducted in full from your UC award.

    Otherwise you both stay on Universal Credit.

    Your sister applying for Carers Allowance will not impact on your UC award.

    hi there thanks for your reply , so he hasn’t applied for esa , we just thought we would be told when to do this , if he doesn’t apply i guess we just stay on universal credit especially if they just take £ for £ off in one hand to pay it out in another date. Or will this depend on what his work assessment comes back with ?

    Ah as you have LCWRA them he can be awarded LCWRA, but won't be paid any extra money as with a UC couple claim the maximum number of LCWRA elements payable is one.

    Adding Carers Element (UC) to your claim is not a route either of you can take, as you already get paid for LCWRA so can't claim for him, and he can't claim it for you as you only get mobility ADP.

    I'd recommend speaking to a local welfare rights organisation.

    thanks again for your reply , I did see that regarding the lwcra that we can’t get two payments of that etc , I have called my local benefit advisor to ask what to do going forward . Thanks
