Pip tribunal won

hello everyone, I want to tell you that I left a message from 2023 behind. now I would like to ask you and please help me because I can only resist. I had the court on September 24 and I won, at which I received a sheet from pip informing me that they cannot pay me, because they want to appeal the decision they made, can you inform me thank you

    DWP can only appeal if there was an error in law, if there was no error they can't appeal it.

    The DWP cannot just appeal the Decision because they do not like it the result, they can only do so if they can show that there was an Error of Law in the making of the Decision, even if they think that this is the case, the Upper Tier Tribunal may not agree with them.

    Unfortunately, it can take some time before the matter is resolved and your award will not be implemented until the DWP have exhausted the process.

    You will receive the same documentation as the DWP and can argue against any appeal that they might make.

    The first stage of the process is for the DWP to request a Statement of Reasons from the Judge of your hearing this may take 6-8 weeks to be produced.

    Just to add DWP do this ocassionally even if there was no error, and the appeal is denied or not followed through once they have the statement of reasons from the judge.

    Unfortunately this doesn't make it easier for you as you'll now have to wait.

    Rubin 16 Thank you for your response, unfortunately my health condition has not allowed me to be active online lately, I have a question about how the deadline for the judge to formulate a statement of decision is calculated from the moment the decision is pronounced or from the moment it is requested by the DWP. Thank you!

    You have won your appeal against the DWP's decision on PIP and they have requested a statement of reasons. The DWP request a statement of reasons to review the tribunal's decision. This request is part of their process to ensure they have a clear understanding of the tribunal's reasoning. The DWP has the right to appeal the tribunal's decision and to request a statement of reasons.

    The DWP request the statement of reasons from the Judge and it can take several weeks to be completed. From the request.

    Trevor_Pip Thank you for your answer, I want to ask you that I won 2 months ago and DWP has one month to appeal, and the deadline has passed, and I called last week and they told me that they are waiting for the statement to pay it. Thank you

    @DanielDod54 if you have been told that, I can't understand what you are asking?

    The DWP cannot progress without the Statement of Reasons. This can be delayed due to the heavy workload of the courts. This would be an acceptable reason for the delay. You need to talk to a benefits adviser on how this will progress as this does not happen to often. When the DWP get the Statement of Reasons it Is an independent court they use, if it goes that far. The DWP may make a decision without going to court.
