How likely successful is a PIP appeal that had been allowed by the Upper Tribunal and sent back to Tribunal to be reheard.

    @AndrewHall there has to be an Error of Law, so the success rate is not high.

    Do you mean the UT has directed it should be sent back to a first tier tribunal (FTT)? If that's the case, then it will be seen by a FTT composed of different members to an initial FTT. I don't know any statistics about this, but would imagine the success rate would be similar to any FTT, as it would be a new hearing at that level.

    This forum has gone down since a very knowledgeable poster (Mr Hughes) was forced out few years ago.

    I don't know if you're meaning to, but you're coming across as really quite rude @AndrewHall 😕 especially as you've already been answered and people were only trying to help

    No one can tell you how likely successful it is, depends on the merits of the appeal. Like Chiarieds said it'll be about the same as the success rates of normal tribunal as it's heard fresh as a first tier tribunal, that number fluctuates but in 2024/2025 quarter 4, 66% of PIP tribunals resulted in a win for the claimant ❤️
