Hi
I've received a letter today from the council saying I now owe them money from April
However I had the severe disability premium on Esa and have read that it's unlawful for the council to do this. Is that correct?
It's been non stop loss of money since transitioning.
Thank you

That you had SDP with ESA is now irrelevant, you have Transitional Protection and TP counts as TP regardless of why someone gets it.
There was a very recent court case against one local authority yes where the claimants won, but it's very early days in terms of seeing what other Local Authorities will do following the ruling, it isn't automatically unlawful at this point in time.
